lol. Come on now, love of Ai aside, you have to admit the songs are similar. I wonder if she gives thanks/credit for inspiration or whatever. If so, then obviously all this is moot. I wonder what the group thinks of it. I haven't seen anything where they've made a statement. Maybe axex bought the rights or paid them off if they were thinking of suing.

I don't have the CD, so I couldn't say. The page does specifically call it "plagiarism" (tousaku), though, so it doesn't sound like it. I would guess it was probably unintentional copying. Like she heard "friend" on the radio, and then a month later she'd forgotten all about it but part of the tune was still in the back of her mind when she wrote "SMILY". The songs are very different overall, though, so I think calling the song "plagiarized" is a little strong.

By the way, the page that compares the SMILY song now has a link from 2004 to something about Sakuranbo. Can anyone translate what it says on those colored buttons? Sounds like video game music to me.

I can't read it all (and in fact Google turns up nothing for some of the terms), but I think it's basically saying "Sakuranbo" sounds like two folk songs. The first one is "A Hiroshima-era song from Koutaku(?)", and the second is "(??) Yamashita's song". I think.

(It says the songs are ouenka, which WWWJDIC translates as "rooters song". I don't know either term, but it sounded like a kind of folk song to me.)

Yeah, that sample definitely sounds like Smily, and the set up of the lyrics are sung is the same way, too. But I don't care. If she had done something wrong, it would be in the news and Aichan would have gotten in trouble by now. She is way to popular in Japan right now for the media to let that go.

isn't sampling of songs allowed? Or is this not that sort of case?

And yeah, like someone mentioned, that song isn't all that complicated a composition. I don't see how it would be such a big deal to use it.

And one more thing, how does the original, made for piano piece of smily sound? Aichan isn't the only one who arranges the songs. It could have been added in the arranging process.

I admit, I haven't been following this thread too closely, as my computer refuses to play the sample mentioned previously. No
It would be nice of you to upload it --either here or in the "Off-Topic Downloads," whichever seems best-- so we can do a full comparison...

Thank you in advance! Love

the melody to both songs sound somewhat smiliar, but not smiliar enough to say that Ai plagerzied wyse's song.
i think Ai's songs have a very catchy and simple melody, so its possible that someone else used the same melody.
if you really think about it, SMILY is way more upbeat and happy-sounding than friend so they arent too smiliar.

Yeah, they sound really similar for sure.

Personally though, I don't care, cause I never liked Smily anyway. I skip it every time.

That is true. the beginning does sound like independent. and with the chorus sounding like wyse's friend... i think she just took parts of different songs and mixed them around

lol maybe they meant the rythem of Independent by Ayu Laughing
During the concert when I first heard Smily (about one week before it's release) I remembered "Independent" when Ai asked us to clap with the smiley face Smile

Everyone knows Wikipedia is an extremely unreliable source of information; unless you can find information from another reputed website that matches the info in wikipedia, you're better off not believing it. And as if Otsuka Ai would plagiarize anyway? If anything, the other artist plagiarized off her!

the thing is, the other songs were released before ai's was
however, another thing is that ai writes a lot of her songs a while before she actually releases them, but its unlikely that those bands would've heard them before

Haha I get your point...I know it probably sounds really lame now but I didnt intend the final sentence to be serious. Looking back, I kinda feel stupid for saying that but too late now
